ROLF obtained the dismissal of an appeal by six competitor nursing homes of a certificate of need for the construction of a new nursing home. The appellants filed their appeal with the Ohio Department of Health (ODH), but they failed to list their legal names or registered trade or fictitious names in their notice of appeal. ROLF attorneys obtained a recommended dismissal from the hearing examiner, which was ultimately adopted by the Director of Health. The appellants were not permitted to re-file their appeal because the appeal deadline had run.
