This session will address some of the increased enforcement activities by the state and federal agencies that oversee the interactions between employers and employees. Participants will learn about the NLRB’s increasingly union-friendly interpretations of protected employee activity (including activity on social media sites), and how out-dated handbook policies could cost an employer dearly in a union election. The EEOC is frequently requiring employers to grant leaves of absence to disabled employees – even when the employee is not eligible for FMLA – and participants will receive guidance on how to handle this often tricky issue. Many employers are being investigated by the DOL and may face substantial liability because of how they classify employees (i.e., exempt, non-exempt, and/or independent contractor). Participants will develop a better understanding of the standards that the DOL applies.
